The two main visa options through which an employer may sponsor you to live permanently in Australia are the:

·        Employer Nominated Scheme (ENS) Subclass 186 visa; and

·       Regional Sponsored Migration Scheme (RSMS) Subclass 187 visa

Under each of these visa categories are two streams:

·       Temporary Transition Stream; and

·       Direct Entry Stream

The Temporary Residence Transition Stream is for subclass 457 visa holders who have worked for their employer in the same position for at least the last two years and their employer wants to sponsor them to remain permanently in that same position. The Direct Entry Stream is for applicants who are untested in the Australian labour market and have not held a subclass 457 for at least the last two years or are applying to enter Australia permanently directly from outside Australia.

The visa scheme allows Australian employers to sponsor skilled workers for a permanent visa to work in Australia. Employees can be from overseas or a temporary resident already in Australia. Applying for an employer sponsored application involves a two-step process:

1.    Employer nominates a position

2.    Employee applies for a permanent visa

Where an employer is sponsoring a worker directly from overseas under RSMS, employers are also required to get regional support from the local government for the position they are looking to fill. The requirements for the nomination and visa application are complex and requires detailed submissions. Mistakes made in your visa selection or application documentation may result in your visa being refused. Since the application fees are not refundable, these mistakes can be costly.
