A common question we get from 457/482 Visa Holder is “I’m 45 years old, can I still get a Permanent Visa?” Unfortunately, after turning 45, options for employer sponsored permanent residency becomes very limited.
As such, if you have already turned 40 – we recommend getting in touch with us to discuss your residency pathway before it is too late.
Some visa holders will have access to special Grandfather Rules which will allow them to access Employer sponsored PR up until the age of 50.
Note: As of 18 March 2022, those applying for transitional 187 or 186 applications will no longer be able to access Grandfather Provisions.

What are Grandfather Rules (Grandafather Provisions)?
Grandfather rules provide consideration to those who applied for their 457 visa before 18th of April 2017, which was the date the government announced the permanent skilled migration program changes.
The rules are quite complex but if you had a 457 or had applied for a 457 on 18th April 2017, you may still be able to apply for a Permanent Residency even if you have turned 45. You must also meet the following requirements:
- You have remained working with the same employer, of whom is your current 457 sponsor
- You’re less than 50 years of age
- You have been employed for at least 2 years
- You have English competency (exemptions exist for those applying for a RMSM Visa who have a minimum of 5 years full-time study in a higher education institute where tuition was delivered in English)
- You hold all the mandatory licensing required for your occupation
